RM5 Million Military Fund Scandal: Major General Claims Trial Over Unauthorized Investment

KUALA LUMPUR, El Sky News – The integrity of the Malaysian Armed Forces’ financial management is under intense scrutiny following the arraignment of a high-ranking officer over the alleged misappropriation of millions in welfare funds.

Major General Datuk Mohamed Fauzi Kamis, 56, currently the Chief of Joint Staff, stood before the Sessions Court today to answer to a charge of Criminal Breach of Trust (CBT) involving RM5 million from the Armed Forces Welfare Fund (Tabung Kebajikan Angkatan Tentera – TKAT).

Detailed Allegations and Procedural Breach

The prosecution’s case highlights a significant breach of administrative protocol. At the time of the alleged offense on November 27, 2023, Mohamed Fauzi held a dual influential role as the Assistant Chief of Staff for Personnel Services and the Chairman of the TKAT Investment Committee.

According to the charge sheet, the accused allegedly directed an additional investment of RM5 million into a private firm, Precious Amber International Berhad. The crux of the legal issue is that this multi-million ringgit transaction was reportedly executed without the knowledge or formal mandate of the TKAT Investment Committee, which is the governing body responsible for safeguarding the welfare of military personnel and their families.

The Legal Framework: Section 409

The charge was framed under Section 409 of the Penal Code, a specific provision dealing with criminal breach of trust by a public servant or agent. Due to the high level of trust placed in the position, the law stipulates severe penalties if the accused is found guilty:

  • A mandatory minimum prison sentence of two years, reaching up to 20 years.
  • Compulsory whipping (caning).
  • A substantial fine to be determined by the court.

Court Orders and Judicial Process

Major General Mohamed Fauzi, represented by his legal counsel, entered a plea of not guilty after the charge was read by the court interpreter.

Deputy Public Prosecutor (DPP) initially proposed a high bail amount, citing the gravity of the case. However, Judge Suzana Hussin set bail at RM100,000 with one surety. To mitigate flight risk, the court has officially impounded the General’s international passport and scheduled a case management session for March 16, 2026.

This case has sent ripples through the Ministry of Defence (MINDEF), as the TKAT fund is primarily intended to provide financial assistance, scholarships, and welfare support to soldiers and veterans.
